Upon signing up for IND-Web.com and The IND-Network Cluster’s services, all customers agree to comply with IND-Web.com and The IND-Network Cluster’s Acceptable Usage policy (AUP). The spirit of the AUP is to ensure customers are using IND-Web.com and The IND-Network Cluster’s services with due regard to the rights of other Internet users and in conformity with the requirements of IND-Web.com and The IND-Network Cluster’s network environment. The AUP are not exhaustive and IND-Web.com and The IND-Network Cluster reserves the right to add, delete, or modify any provision of its AUP at any time without notice, effective upon either the posting of the modified AUP to www.ind-web.com or notification of the modified AUP. Any complaints about a customer’s violation of the AUP should be sent to abuse at ind-web.com.

Actions Taken by IND-Web.com and The IND-Network Cluster

The failure by a customer to meet or follow any of the Terms of Use (TOU) is grounds for account deactivation. IND-Web.com and The IND-Network Cluster will be the sole arbiter as to what constitutes a violation of the Terms of Use. IND-Web.com and The IND-Network Cluster reserves the right to remove any account without prior notice. When IND-Web.com and The IND-Network Cluster becomes aware of an alleged violation of its Terms of Use, IND-Web.com and The IND-Network Cluster will initiate an investigation. During the investigation, IND-Web.com and The IND-Network Cluster may restrict a customer’s access in order to prevent further potentially unauthorised activity. Depending on the severity of the violation, IND-Web.com and The IND-Network Cluster may, at its sole discretion, restrict, suspend or terminate a customer’s account and/or pursue other civil remedies. If such violation is a criminal offence, IND-Web.com and The IND-Network Cluster will notify the appropriate law enforcement authorities of such violation. IND-Web.com and The IND-Network Cluster does not issue credits for outages incurred through service disablement resulting from Terms of Use violations. IND-Web.com and The IND-Network Cluster customers agree to indemnify and hold harmless IND-Web.com and The IND-Network Cluster from any claims resulting from the use of our services that damages them or any other party. The IND-Web.com and The IND-Network Cluster service is provided on an as-is-available basis without warranties of any kind, either express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose or non-infringement. IND-Web.com and The IND-Network Cluster expressly disclaims any representation or warranty that the IND-Web.com and The IND-Network Cluster service will be error-free, secure or uninterrupted. No oral advice or written information given by IND-Web.com and The IND-Network Cluster, its employees, licensers or the like, will create a warranty; nor may you rely on any such information or advice. IND-Web.com and The IND-Network Cluster and its partners and suppliers will not be liable for any cost or damage arising either directly or indirectly from any transaction or use of the service.
